Liability Waiver and Assumption of Risk

Participation in water biking involves physical activity and exposure to outdoor and water-related conditions. Before participating, all guests must read, understand, and agree to this Liability Waiver and Assumption of Risk.

By booking or participating in an activity with TiKi Water Bikes, guests acknowledge the risks involved and agree to follow all safety instructions provided by our team.

Assumption of Risk

Guests understand that water biking may involve inherent risks, including but not limited to:

  • Falling into the water

  • Slips, trips, and falls

  • Collisions with other watercraft, equipment, docks, objects, or participants

  • Changing weather and water conditions

  • Wind, waves, currents, and reduced visibility

  • Equipment malfunction or unexpected movement

  • Physical strain, fatigue, dehydration, or sun exposure

  • Injury caused by the actions of other participants or third parties

  • Delayed access to emergency or medical assistance

Guests voluntarily accept and assume all known and unknown risks associated with participating in water biking and related activities.

Health and Physical Condition

Each guest is responsible for determining whether they are physically and medically able to participate safely.

Guests should not participate if they have a medical condition, injury, illness, mobility limitation, or other concern that may make water biking unsafe.

Pregnant guests or individuals with heart conditions, balance concerns, recent injuries, or other medical conditions should consult a healthcare professional before participating.

Guests must inform TiKi Water Bikes staff of any condition that may affect their ability to safely operate or ride a water bike.

Safety Instructions

Guests agree to:

  • Attend and follow the required safety briefing

  • Wear a properly fitted life jacket at all times while on the water

  • Follow all instructions given by TiKi Water Bikes staff

  • Remain within the designated operating area

  • Use the equipment only for its intended purpose

  • Operate the water bike carefully and responsibly

  • Avoid reckless, dangerous, or disruptive behaviour

  • Return to shore immediately when instructed

  • Respect other guests, water users, wildlife, and the environment

TiKi Water Bikes reserves the right to refuse or end participation when a guest does not follow safety instructions or presents a risk to themselves or others.

Alcohol, Drugs, and Impairment

Guests must not participate while impaired by alcohol, cannabis, illegal drugs, medication, or any substance that may affect judgment, coordination, balance, or reaction time.

TiKi Water Bikes may refuse participation without a refund when a guest appears impaired or unable to operate the equipment safely.

Equipment Responsibility

Guests agree to inspect the equipment and report any visible damage or concern before leaving shore.

Guests must not modify, misuse, damage, abandon, or remove any equipment from the designated area.

The person responsible for the booking may be held financially responsible for loss or damage caused by misuse, negligence, reckless behaviour, or failure to follow instructions.

Normal wear and tear will not be charged to the guest.

Release of Liability

To the fullest extent permitted by applicable law, guests release and hold harmless TiKi Water Bikes, its owners, employees, contractors, representatives, partners, property owners, and affiliates from claims, demands, losses, damages, expenses, or legal actions arising from participation in water biking or related activities.

This release includes claims relating to personal injury, property damage, illness, disability, or death, except where liability cannot legally be excluded.

Indemnification

Guests agree to indemnify and hold harmless TiKi Water Bikes and its representatives from claims, damages, costs, or expenses resulting from:

  • The guest’s actions or negligence

  • Failure to follow safety instructions

  • Damage to equipment or property

  • Injury or loss caused to another person

  • Violation of applicable laws, rules, or operating requirements

Minors

Guests under the age of majority must have this waiver completed and accepted by a parent or legal guardian.

The parent or legal guardian confirms that they:

  • Have reviewed and understood this waiver

  • Consent to the minor’s participation

  • Accept the risks on behalf of the minor

  • Agree to the applicable release and indemnification terms

Children must meet all age, size, supervision, and safety requirements established by TiKi Water Bikes.

Personal Belongings

Guests are responsible for their own personal belongings.

TiKi Water Bikes is not responsible for lost, stolen, damaged, or water-damaged items, including phones, cameras, wallets, clothing, jewellery, bags, or other personal property.

Guests are encouraged to leave valuable items on shore or use appropriate waterproof protection.

Emergency Assistance

Guests authorize TiKi Water Bikes staff to provide or arrange reasonable emergency assistance when necessary.

Guests understand that they may be responsible for costs associated with emergency transportation, rescue services, medical treatment, or other assistance.

Photography and Media

TiKi Water Bikes may take photographs or videos during activities for safety, operational, promotional, or marketing purposes.

Guests who do not wish to appear in promotional content should notify a staff member before participating.

Where separate consent is required, TiKi Water Bikes will request permission before using identifiable images for promotional purposes.

Compliance With Rules

Guests agree to comply with all applicable laws, local regulations, boating rules, beach rules, and instructions provided by TiKi Water Bikes staff.

Failure to comply may result in the immediate end of the activity without a refund.

Acknowledgement

By signing or electronically accepting this waiver, the guest confirms that they:

  • Have read and understood the entire document

  • Have had the opportunity to ask questions

  • Understand the risks associated with water biking

  • Are participating voluntarily

  • Agree to follow all safety requirements

  • Accept the release, assumption of risk, and indemnification terms

This waiver applies to the booking date and any related participation identified in the reservation or waiver form.
